The man accused of murdering a Busselton woman in a head on crash near Capel last February has been remanded in custody until he appears in court again on August 30.
The Busselton Dunsborough Mail understands that the accused was unable to make a plea in court and that his lawyer has questioned his ability to stand trial.
Shaun Southern, 45, from Bunbury is charged with murder, acts or omission causing bodily harm or death and reckless driving in relation to an incident that occurred along the Bussell Highway on February 18.
It is alleged that Mr Southern drove onto the wrong side of the highway on a Saturday afternoon, forcing dozens of oncoming motorists to swerve or drive their vehicles at high speed into roadside ditches to avoid a collision.
Mobile phone footage recorded by witnesses showed his four wheel drive swerving onto the wrong side of the road before it collided with 61 year old Jenni Pratt's vehicle.
Miss Pratt, a mother of two from Geographe, died at the scene and her passenger, a 54-year-old woman from Busselton, was taken to hospital with serious injuries.
Mr Southern has been in hospital since March 20 and was initially charged during a bedside hearing as he recovered from serious injuries from the crash in hospital.
