A 67-year-old Collie man was fined $300 in the Collie Magistrates Court after refusing to accompany police officers back to the police station because he “wanted to go home”.
Marshall Alan Ellis-Smith did not appear in court on Wednesday, January 23 and was found guilty of one charge of failing to comply with requirements made by a member of the police force.
Police prosecutor Sergeant Greg Ward told the court police had pulled over Ellis-Smith’s vehicle on Throssell Street at 10.34pm on December 7 last year for a random breath test.
He said police conducted the breath test – which came back negative – before conducting an oral drug swipe test.
Sergeant Ward said, as a result of the oral swipe, police asked Ellis-Smith to accompany them to the police station for a further test, which he refused because he “wanted to go home”.
Magistrate Greg Smith imposed a $300 fine for the offence, along with court costs.
He also imposed a three-month disqualification of Ellis-Smith’s driver’s license.
